III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection, flown on May 18, 1999. The digital pictures were reviewed on May 28, <br />1999, by Joe Dudash of the Colorado Division of Minerals and Geology. No compliance problems <br />were observed during the overflight. <br />Hvdroloey <br />The sedimentation ponds B and C had considerable amounts of water in them. Water levels were <br />above the primary tubes, but neither of the ponds appeared to be discharging. Pond embankments <br />appeazed to be stable. There were no erosional problems at the entrance SAE. <br />Facilities <br />There were no problems with any of the facilities. The berm on the outer edge of the portal bench was <br />intact. No problems were observed with fugitive dust. There was no evidence of cut or fill slope <br />instability at the mine site. Storage of mining equipment on the east side of the portal bench was <br />orderly. <br />Roads <br />All of the roads were dry and in excellent shape. No problems with fugitive dust were observed. <br />Refuse Pile <br />A compactor was situated on the refuse pile top. Uncompacted coal and the vent shaft muck were on <br />the top of the pile. No obvious signs of erosional gullying were seen on the refuse pile outslope; There <br />were no signs of ponding water on the refuse pile top. <br />c:\ms97\bowie2\insp5996 <br />
