IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and <br />date of abatement for the violation, previous violations still requiring abatement and the termination of <br />violations cited during previous inspections. <br />Three Notices of Violation were issued as a result of this inspection; CV-2002-015, 016, and 017. These <br />violations are listed below. There are no outstanding violation abatements from previous inspections. <br />NOV CV-2002-015 <br />Failure [o properly water or otherwise manage refuse disposal area working surface to effectively suppress <br />fugitive dust emissions so as to comply with all applicable state and federal air quality statutes and <br />regulations. <br />Location: Refuse Disposal Sub-Area SA <br />Abated on 7/10/02 and Terminated on 7/11/02. <br />NOV CV-2002-016 <br />Failure to provide for proper surface drainage during coal mine waste pile construction in accordance <br />with approved plan and applicable regulations. <br />Location: Refuse Disposal Sub-Area SA <br />Abatement 1: Complete temporary refuse stockpile removal and grading as necessary to eliminate <br />depression on surface of refuse pile by Aueust 15, 2002. <br />Abatement 2: Submit a complete technical revision application addressing plan modifications as <br />necessary to ensure compliance with water control provisions of 4.10.3(2) and 4.09.2(7) by Aueust 1, <br />2002. <br />Abatement 3: Implement all necessary measures to ensure that, during and upon completion of li:P- <br />5A, surface runoff from the fill surface will be diverted to stabilized channels off the fill, that will <br />safely pass the runoff from a 100 year-24 hour precipitation event. Final implementation shall be <br />completed within 20 davs of final aouroval of the technical revision. <br />NOV CV-2002-017 <br />Improper ditch construction or maintenance which resulted In erosion of two sediment pond collection <br />ditches; and improper ditch maintenance which exposed a buried pipe segment which could have resulted <br />in disturbed area drainage being routed around the sediment pond into Scullion Gulch without treatment. <br />Location: Prep Plant Ditch at SE corner of Prep Plant Bench, lower segment of same ditch, and segment of <br />South Silo Ditch on bench outslope north of Prep Plant Ditch. <br />Abatement 1: Install riprap as necessary to stabilize eroded ditch segments on the Prep Plant Ditch <br />and South Silo Ditch as necessary to prevent additional downcutting or sidecutting erosion.
