~:. <br /> <br />INSPECTION REPORT - PAGE 2 <br />FILE N0. <br />DATE: <br />OBSERVATIONS OF IMPORTANCE: <br />AND RECOMMENDATIONS <br /> <br />1) Technically, Kilgroe-Atchison Paving Co. is the operator with a financial <br />warranty of $7,000 still on deposit with the State Treasurer's Office. <br />2) On January 29, 1481, the Mined Land Reclamation Board approved the suc- <br />cession of operator from Kilgrow-Atchison to Albert Frei & Sons, Inc. with <br />financial warranty set at $9,500. The operator submitted a deed of trust <br />warranty, however, problems with this warranty were not worked out, there- <br />fore, the warranty was not accepted. <br />3) Upon review of the existing mine related disturbance, it is obvious that <br />a $9,500 financial warranty would be insufficient to reclaim the site if <br />the state was required to do so due to default. Therefore, please provide <br />a map which clearly portrays all of the existing disturbance, indicate acres <br />disturbed, cubic yards of topsoil and overburden stockpiled, lake shoreline <br />grading to 3:1 as per rule 6, etcetera. Also, please provide a detailed <br />reclamation cost breakdown for reclamation of the site at the worst case <br />i.e.; today's disturbance plus additional disturbances planned for. I would <br />request that the operator provide this information at least two weeks prior <br />to the September 26-27, 1984 Board meeting so that the information could be <br />RB¢QEOIBeIQI(RI(01'I(g(X reviewed and an amount agreed upon for presentation to the <br />Board at the September meeting. <br />4) The operator may wish to request a partial release of the fish ponds, build- <br />ings, etcetera which were sold. I noted that a considerable portion of the <br />new landowners property has not had topsoil replaced, reve9etation or proper <br />shoreline grading. The operator will have to request a variance in the per- <br />formance standards and demonstrate why the variance is necessary and how the <br />public will be protected if the shoreline is not graded to the requirements <br />of Rule 6. <br />5) The lake on the northwest end was breached into the South Platte River and <br />wash water is entering the lake on the east end. The operator should review <br />the NPDES permit requirements and take the appropriate action such as closing <br />the break. <br />6) When rip-rapping critical locations, the operator should first iay back the <br />slope to be protected. Next, clean rock, broken concrete (without rebar) or <br />old asphalt can be used to armor the bank, followed by covering the rip-rap <br />material with soil and planting the covered rip-rap with grass, trees and <br />shrubs. <br />(Rev. 9/83) <br />Doc.
