(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~~-tvst~-t n6 <br />INSPECTION DATE: t-~~-n~ INSPECTOR=S INITIALS: ~- <br />OBSERVATIONS <br />Completed an inspection of this operation pursuant to requirements of Rule 4.16.2(2) offer the Division received <br />a request for release of reclamation responsibility from the operator. <br />This is a 35 acre 112 permit located about 1 mile south of Wild Horse, Colorado on the west side of highway 287. <br />Mining progressed from southeast to northwest. The site has been adequately graded, topsoiled but not seeded. <br />A small 1/3 to'/z acre area in the northwest corner of the permit is being used to store various construction <br />equipment (culverts, etc.). This is not compatible with the approved post mining land use (agricultural). Also, if <br />the equipment is not removed, or the post mining land use changed, the operator will not be able to finalize <br />reclamation. <br />The access road has not been reclaimed because it is still being used to access the storage area. The <br />operator's representative stated that the road will remain open to provide access to their property. Could not <br />find any document in the file stating that the road will not be reclaimed. If the operator has documentation <br />demonstrating that the road will not be reclaimed, please send a copy fo the DMG. Otherwise, the road will <br />need to be reclaimed or a permit revision will need to be submitted to modify the reclamation plan. <br />As noted above, the operator submitted a request for a release of the reclamation responsibility. However, the <br />site has not been fully reclaimed. The disturbed areas do not have any vegetative cover; as required by the <br />approved permit. Therefore, the request for release is being denied. <br />The operator can re-submit a release request as soon as the site is revegetated with the approved seed mix <br />and the access road and storage area problems are resolved. <br />Mr. Randall, County representative, asked about amending the existing permit area.
