This inspection was conducted per the operator's request. Present at the inspection were Kate, DMG, and <br />Heriberto "Eddie" Perez, Right of Way Clean-up. Weather at the time of inspection was cloudy, windy, and <br />approximately 40 degrees. <br />2. The operator at this site is required, as outlined in Technical Revision 001 (TR-0Ol ), to dig 4 to 6 test holes on <br />the site in the vicinity of an earlier diesel fuel leak while using an instrument that detects the presence of <br />hydrocarbons to test the soils. The operator is to have obtained the allowable limits for diesel fuel that is tested <br />in this manner, prior to the excavation of the test holes. A representative of DMG is to be present during <br />sampling to supervise the operation. <br />3. Mr. Hiner left a message on February 26, 2004, indicating that he was prepared to go forward with the <br />excavation of the test holes and wanted to perform the tests the following day. The Division contacted Sharon <br />Hiner on February 27, 2004 and arranged to conduct the testing at 1400 hours the same date. Ron Richardson <br />was to oversee the operation, and the Division contacted Mr. Richardson to confirm the plans and to assure <br />that a hydrocarbon detector would be available at the site. Mr. Richardson stated that he was in the process <br />of obtaining the instrument. <br />4. Upon arrival at the site at 1400 hours, the only representative of Hiner Construction who present was the <br />backhoe operator, Mr. Perez. Mr. Perez did not have a key for the gate at the site. Mr. Richardson was <br />contacted by phone. Mr. Richardson stated that he was not able to acquire the required instrument for testing <br />at the site and was unable to get in touch with Mr. Hiner. Evidently the phone number he had for the Division <br />was incorrect because he stated that he had been unable to contact anyone at the Division. Therefore he <br />was under the assumption that the project had been cancelled for the day. He indicated that we could still <br />dig a hole or holes at the site and do a visual analysis, but that he would not be present because he was in <br />south Denver at the time. In that the TR specifies that a detector will be used while the holes are dug, that <br />option was not chosen.
