III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete inspection of the West Elk Mine was performed by <br />Christine Johnston of the Division. The inspection took place <br />April 26-27, 1994. The weather during this period was cloudy and <br />cool with periods of rain and snow. It snowed overnight on April <br />26th; minor amounts of accumulation. Henry Barbe of Mountain Coal <br />Company (MCC) accompanied me during the inspection, with the <br />exception of an inspection of Lone Pine Gttlch and Dave Nicewicz, <br />also of MCC, accompanied me. I also discussed a number of <br />permitting issues with representatives of MCC. Mr. Barbe and I <br />discussed current revisions, upcoming revisions and report <br />submittals. Mark Scanlon and I discussed upcoming drilling <br />projects that will take place this summer on and off the permit <br />area. Mr. Barbe, Bob Koch, and I discussed the proposed fan in <br />Lone Pine Gulch. <br />AVAILABILITY OF RECORDS <br />Records for the West Elk Mine were reviewed at the mine office. <br />Please see the accompanying records checklist for records reviewed. <br />Pond inspection reports and NPDES Discharge Monitoring Reports have <br />been completed for the first quarter 1994, but require a P.E.'s <br />signature and stamp, and then will be s«bmitted to the Division. <br />MCC is currently working on the 1993 Annual }lydrologic Report and <br />the Semi-Annual Subsidence report for the last part of 1993. These <br />reports are due April 30, 1994. <br />SIGNS AND MARKERS <br />The Lone Pine Gulch drilling area was inspected. Only one permit <br />boundary sign exists at the gate which separates Larry Mautz's <br />property from ARCO's property. There were no property boundary <br />signs in the drilling area as recommended by the Division during <br />review of minor revision 117 and 121, <br />ROADS <br />The road constructed by P1CC to access two additional trenching <br />sites in Lone Pine Gulch was inspected. The Lone Pine Gulch road <br />up to the drilling site was extremely muddy and could only be <br />accessed by ATV or on foot. No effort was made to control drainage <br />from slopes above the existing road, which may have contributed to <br />the condition of the road. The constructed road for this project <br />was also extremely muddy. Some material has been pushed off the <br />side. The operator felt this material could be retrieved to <br />reclaim the road.
