The pit Is a county aperatlon that produces gravel by eroshlug rock excavated Vom a rock stlde and etockpltlug the product on the Dat
at the bottom a[ the soda. The permit indicates that Ute slopes will be malutalued at a 3:1 [0 4:1 slope as rock Is pushed 60 feet down the sOde hom
a 400 toot long beach.
Ltirtently the 400 foot long beach Is virtually gene ou the southern 200 feet sad it appears that the county has begun mlNng tLls area by excavatlug
the toe of the sOde and using gravity feed to replace rack at the toe. This mlWog method has created slopes that appear to be at an approximate
1:1 slope. Addltleually, the sOde zoue that rechazges the rock at the toe of the slope extends approximately 200 feet up the elope instead of We
permitted 60 feet The stlde zone Is now encroaching ou Ceuu[9 Road M25 above the pit The road accesses mine faclRtles beleuglug [o Suuoyslde
bold Corporatlou and coutlnues as pubOc access to the fake Emma area I[ appears [hat San luau Csuo[9 could have conducted mining operatlons,
as permitted, from the uorthero 200 feet of the beach road rather than excavatlug the tae out of the curteut excavatluu area which Is uo[ an approved
operatlos. Al this polat IL may be Impossible to achieve the permitted 3:1 - 4:1 Dual slopes without Importatlea of material.
San luau County must conduct backDlDug operatlone on the over-excavated slope so that the required 3:1 grade le eatabOShed sad the stahlDty of
County Road N25 above the site Is re-established. Any Nture excavatloa at We site should 6e conducted according to the approved mining plan. Ir
San ]uan County wishes to change their mising plan, a revision to their permit will need to be submitted to the Divlslan.
The permlUdlaturbed area boundary Is not cleazly mazked on a map In the permit nor are tltere soy disturbed area boundary markers or a mine
IdeutlDcatlao sign Installed at the site as required 6y Rule 3.1.12. Therefore It Is unclear whether or sot any off-alts damage has occurred at the
site. It Is possible that the elide zoue encroaching upward to County Road N25 may he considered off-alts damage. Addltlonally, some of the atockptlea
may be placed beyond We permit boundary. Sea ]uan County wID need to submit a map that cleazly deDueatea the 3 acre permit azealdisturbed area
boundary and Install the disturbed azea boundary markers sad mine idestlflcatlon alga to adequately deDne We boundaries on the ground. Due to
the high tourist vlaltatlan to the area, It Is recommended that the markers and alga be constructed adequately to deter their removal.
The permit Indicates that none o[ the spruce Veea or cottonwood Vees ou site will be deaVayed. The aor[hem mast stockpile has beau placed so
that It partlally buAes same of these Vees. It appears that it has k111ed at least sue o[ Utem and may kill more. Sau Juan County wID used to move
this smekplle away Irom any trees, taking care not to destroy them In the process. Auy Veea that are destroyed wID need ta 6e replaced by San
Juan County ae committed ta In the approved permit
I & 6 Contact Address cc: Tom 61Wa, DNI6
^ CB
NAlf6 fuels 6lrodo ^ BL
OPERATOB San Juan Counb ^ PS
STREET 1512 Creeue Street ^ NW
CTTYISTATEf!]P Sllverten.
