III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />the pond embankment outslope. At the time of the inspection, there was no longer flow in <br />the ditch. <br />Regulation sections cited were 4.03.111)(a) [general haul road requirements], 4.03.1(4) <br />[haul road drainage design, construction and maintenance], 4.03.1(4)(a)(iv) [construct haul <br />roads not within disturbed area to minimize erosion, resultant siltation, and disturbance to <br />hydrological balance], and 4.03.1(6)(al [maintain haul roads to meet approved or required <br />design standards throughout the life of the facility]. <br />Permit Sections cited were Exhibits 13-2 and 13-10. Exhibit 13-2 is titled Surface <br />Hydrology Map, certification date of Dec. 7, 1998. The map depicts Ditch HRD-A2-ME 5 <br />running from the road curves above Pond 006 along the inside of the road past the pond <br />embankment and continuing on down the road. Exhibit 13-10 is titled Typical Road Detai/s, <br />certification date of Nov. 5, 1990. The exhibit specifies that roadside ditches would be <br />constructed as "V" ditches with 2:1 side slopes. Permit Table 13-3 indicates that the <br />specific design applicable to "V" ditches along the Mine Entrance Road and Haul Road A is <br />the typical design on Ex. 13-10 labeled Typical Berm Ditch "B", which is a 1' deep ditch to <br />the inside of a safety berm at least 2 feet high. <br />Digital Photos 431 through 434 are of the road ditch segment, embankment erosion, and <br />sediment deposition area on x&716/03. <br />~~ 4 <br />By the afternoon of April 17, 2003, the segment of ditch where the breach occurred had <br />been effectively repaired, such that the remedial abatement Item 1 was satisfactorily <br />abated. Photos 461 through 463 are of the same area on the afternoon of~@J77/03, <br />following ditch repairs. yrp ~ <br />NOV CV-2003-003 <br />NOV CV-2003-003 was issued April 17, 2003, based on observations made during field <br />inspection on April 16, 2003. The NOV was issued for [flailure to p/ace or grade backfilled <br />material to minimize erosion and off-site effects, and failure to design, construct, or <br />maintain disturbed area road ditches and road ditch relief down-drains to safely pass runoff <br />and minimize, contro% or prevent erosion. <br />The NOV applied to Hau/ Road G road ditches and ditch relief out/et drains on both sides of <br />the road, from lower end of the D Pit rough graded spoils down to and including the <br />riprapped ditch relief outlet drain below the outlet of the 36" CMP that conveys flow from <br />NE side to SW side of road, upstream from Pond 005. Drainage from large area of graded <br />spoil flowed down the NE road ditch rather than into a natural drainage as shown on Exhibit <br />20-2. This additional flow may have caused or exacerbated ditch and relief drain erosion. <br />There were two abatement items to be implemented by May 30, 2003. Item 1: Regrade <br />lower D Pit spoi/s io establish design drainage into natural channel and away from Rnad G <br />NE Ditch. Item 2: Regrade eroded Road G ditches and ditch relief down drain segments to <br />
