A site inspection of the Platte Valley Pit was conducted in response to the following <br />citizen complaints: Joe Sasaki - 5/22/02; Stephan Brancucci - S/21/02; Don & Helen Thorpe <br />- 4/29/02; Tom Spain - 4/29/02 (attached are copies of complaint letters). The citizen <br />complaints allege adverse affects to domestic and irrigation wells north of Brighton and <br />east of Colorado Highway 85 due to dewatering operations at the Platte Valley Pit. The <br />Platte Valley Pit is located immediately east of the South Platte River and west of <br />Highway 85, approximately 2 miles north of Brighton. Present during the inspection were <br />the following: Aggregate Industries - Mike Refer, Jamie Gaboriau, Tony Warren (plant <br />manager), and Bill Warmack (consultant); Office of the State Engineer - Kevin Rein, George <br />Van Slyke; Division of Minerals & Geology - Tom Schreiner. <br />2. A private meeting was held with the complaintants after the field inspection at the <br />offices of Golden West Farms. Present at the meeting were the following: O€f ice of the State <br />Engineer - Kevin Rein, George Van S1yke; Division of Minerals & Geology - Tom Schreiner; <br />complaintants - Stephan Brancucci, Donnie Thorpe, Tom Sasaki, Joe Sasaki, Tom Spain. <br />3. The Platte Valley Pit is permitted for a total of 141 acres with a maximum disturbance at <br />any one time of 29.5 acres. The mine plan specifies open pit, dry mining and dewatering <br />methods with discharge to the South Platte River via an NPDES Permit from the Colorado <br />Department of Health. The mine plan also specifies a phased approach to mining and <br />reclamation, and includes a 100' setback from the South Platte River for all excavations. The <br />site will be reclaimed to developed water resources. The reclamation plan specifies that two <br />(2) excavated cells will be clay lined for future water storage. Pit slopes will be regraded <br />to a maximum of 3:1, topsoiled, and revegetated above the anticipated water line. Remaining <br />affected lands will be topsoiled to a depth of 6" to 10" and seeded with rangeland grasses <br />(blue grama, sideoats grama, western wheatgrass). The operator has submitted a financial <br />warranty of $95,000 in the form of a corporate surety. <br />4. The nature of the citizen complaints were discussed between all parties present at the <br />inspection. Ms. Gaboriau indicated that Aggregate Industries, Inc. (AII) is aware of the <br />citizens concerns and has made efforts to remediate possible affects of dewatering to the <br />well owners. The attached correspondence from Aggregate Industries, Inc. dated May 30, 2002 <br />details the various efforts of Aggregate Industries, Inc. to provide assistance to a number <br />of well owners in the area of concern. Ms. Gaboriau also indicated that Aggregate <br />Industries, Snc. has commissioned Bill Warmack of Applegate Group, Inc. to conduct an in- <br />depth groundwater modeling study to determine the extent and magnitude of groundwater impacts <br />from dewatering and dry mining activities at the Platte Valley Pit. Mr. Warmack anticipates <br />4-6 weeks will be required to complete the study. Mr. Warmack has already completed a <br />preliminary study to determine to what extent the dewatering operations at the site may have <br />had upon water level declines in area irrigation and domestic wells. Mr. Warmack's <br />preliminary study, dated April 17, 2002 (see attached copy), indicates minimal if any impact <br />on the irrigation and/or domestic wells due to dewatering activities. <br />5. The details of the operator's dewatering and water management activities at the Platte <br />Valley Pit are as follows: <br />The on-site pre-disturbance water levels were approximately 6' below ground surface <br />
