SITE EVALUATION INSPECTION REPORT NARRATIVE PAGE 2 <br />Terror Creek Loadout <br />A small area exemption was granted for the outslope of the pad <br />next to the tracks as well as the immediate loading area. I <br />discussed the variance with the manager, Mr. Chilton. He said <br />that the State agreed to allow an exemption if the area was <br />topped with fine gravel. This material is supposed to filter <br />out the coal fines before the runoff leaves the area. <br />The area has been designated as an alluvial valley floor by <br />the MLRD. The company is not removing any overburden so the <br />State is not requiring them to monitor groundwater in the <br />area. They also do not have to monitor the North Fork of the <br />Gunnison River, (surface water). <br />The soils in the permit area are not classified as a prime <br />farmland series. <br />A small area, less than an acre in size, is being used for <br />equipment storage. Topsoil has not been removed from the area <br />because the State has issued an exemption. Mr. Chilton was <br />not clear on the conditions of the exemption. I discussed the <br />situation with Dan Matthews, one of the State inspectors who <br />is familiar with the area. He said that the company is not <br />authorized to store any oils or greases on the area. The <br />State regulations 3o not have a provision for a topsoil exemp- <br />tion. A tenday notice is being issued. <br />
