III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash and Jim Stark of the <br />Colorado DMG. No representative of the operator was present during the field <br />inspection. According to the operator, the area has been receiving heavy rains in <br />the past few weeks. Rain was threatening during the inspection. <br />Hydrology <br />The water level in pond 1 was 3 feet below discharge. The gated valve was <br />closed. The pond 2 embankment was well grassed and appeared to be stable. <br />There was no gullying on the inslopes or outslopes of the pond. <br />Pond 2 was dry. The open spillway was functional. The outslope needs some <br />seeding for erosional stability. The pond inslope was well vegetated. <br />All of the culverts and ditches around the mine site were functional <br />The straw bales and silt fences were up at the railroad track SAE. However, <br />more protection needs to be added around the open channel of the irrigation <br />ditch just before it passes into the culvert underneath the tracks. <br />Topsoil <br />There were no erosional problems at the two topsoil stockpiles. Topsoil signs <br />were present. Collection ditches were separate from the diversion ditches. <br />Facilities <br />The berm at the outer edge of the facilities bench was functional. No problems <br />were observed with any of the facilities. No problems with fugitive dust were <br />observed. <br />C:\ms97\te rror\i n sp0899 <br />
