:; <br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone 1970) 247-5469. Operations were active during the time of this <br />inspection. Tom Bird was at the mine, but not available to accompany the DMG <br />inspector. <br />Signs & Markers -Mine identification sign and safety signs were posted at the mine <br />entrance. Permit boundary markers were observed. Public access is controlled by gate <br />and fence, gate was open. <br />Roads -Mine entrance road and access roads were well maintained. Mine entrance <br />road drainage conveyance swale was intact. <br />Hydrologic Balance -Affected area drainage was conveyed to one of the two sediment <br />ponds for treatment. Sediment containment ditches and culverts appeared functional. <br />Upland diversion ditched and culverts appeared intact and functional. Debris screens <br />were intact within the upland diversion ditches. Mine personnel were watering yard <br />area for dust suppression. <br />Large sediment pond was holding water approximately 6" depth. Sediment had been <br />recently cleaned from the large pond. Primary and secondary spillways appeared <br />stable and clear of debris, debris screen was intact for the primary spillway. No <br />discharge noted. Overflow pipe, 0.6' PVC pipe installed to convey overflow from the <br />large sediment pond to the smaller sediment pond, was intact and clear, no evidence of <br />overflow being conveyed. Pond embankment appeared stable, evidence of seeping, <br />slumping, or erosion was not observed. <br />Small sediment pond was holding water, approximately 1' depth, no discharge noted. <br />Primary and secondary spillways appeared stable and clear of debris. Embankment <br />was well vegetated and stable. <br />Fuel storage tank, located adjacent to coal storage bins, was surrounded by spill <br />containment berm. Evidence of minor fuel spills appeared to be contained within the <br />bermed area. Six 55-gallon drums, containing lubricants, were located on elevated <br />rack. Lubricant storage rack was surrounded by spill containment berm. Empty <br />lubricant drums were located adjacent to the bermed area. <br />
