<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Hamilton Coal Mine was conducted by DMG staff from <br />the Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) <br />247-5469. No activities were observed. Operator has commenced final reclamation. <br />Mine identification signs and permit boundary markers were posted. Mine access <br />roads were well maintained. Road side drainage ditches and culverts appeared clear <br />and functional. <br />Weeds, including several varieties of thistle and knapweed, were observed along <br />portions of the access roads within the permit area. The operator is encouraged to <br />employ appropriate weed control methods to ensure that the noxious weed infestation <br />not spread to reclaimed areas and displace the desired vegetation. <br />Sediment pond A and B were dry. Primary and secondary spillways appeared clear and <br />stable, no discharge noted. Pond embankments appeared stable, no evidence of <br />seeping, slumping or excessive erosion observed. Canada thistle were present on <br />portions of the pond embankment for pond 8, located at the NE corner of the permit <br />area. <br />
