III. COMMENTS -COMPLIANCE <br />Below are comments on thentspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />Mazch 25, 2003 by Mike Boulay of the DMG. There was no representative from Kes Coal <br />Company present during the inspection. Weather conditions were cold and clear. The majority <br />of the site was snow covered. Access to the site was limited due to heavy snow pack in most <br />locations of the mine. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Hazza office in Steamboat Springs on the <br />afternoon of March 25, 2003. Please continue to maintain the files and update the records on a <br />regulaz basis. <br />Roads <br />The permanent light use road that accesses the site was partially snow packed and very muddy in <br />some locations. This road was not passable beyond the approximate location of Pond D. Tire <br />tracks were appazent up to this point. Someone had recently attempted to access the site but <br />could not go beyond this point due to the heavy snow pack and poor road conditions. There was <br />no activity at the mine site during the inspection. <br />Hydrologic Balance <br />Site sedimentation ponds D, E, F, and G were viewed. Pond D was retaining water but not <br />dischazging. The surface of Pond E was frozen and partially snow covered. Pond E was <br />retaining water at a level well below the level of the primary spillway. The surface of Pond F <br />was beginning to melt and was retaining water at a level well below the primary spillway. The <br />surface of Pond G was entirely melted and was retaining a significant amount of water. Pond <br />inlets and embankments were mostly snow covered at all pond locations and none of the ponds <br />were dischazging at the time of the inspection. <br />Loadout <br />The majority of the loadout azea was free of snow cover. The site was saturated from recent <br />snowmelt and runoff and many areas of the loadout had standing water at the surface. The <br />loadout pond was retaining water. No problems were noted at the loadout facility. <br />
