A complete inspection of the site was performed on 4 May 2004. The inspection verified that the
mine azea remains stable and in overall good condition. The vegetative cover was good and no
problems with erosion were noted.
The Division believes, at this time, that the public health and safety concerns at the Ohio Creek No.
2 Mine aze minimized and have been reduced to the extent possible. As the reclamation at the site
gets "older", the vegetation will become even more established, further stabilizing the areas and
further limiting the potential for safety, health and environmental problems.
Pursuant to Rule 5.02.2(8), the Division proposes to reduce the statutory inspection frequency of
the Ohio Creek No. 2 Mine as set forth in Rule 5.02.2(1). The Division proposes to perform two
complete inspections at the site each yeaz. The fast inspection will be carried out in the spring
(Mazch, April or May), in conjunction with the run-off period. The second inspection would be
carried out in the fall (September, October or November) after the summer thunderstorm period.
This concludes the Proposed Decision and Written Findings for Reduced Inspection Frequency for
the Ohio Creek No. 2 Mine.
