Construction Material Operations that do not Require a Financial Warranty
Dear Mr. Champ:
On August 27, 1981, the Division of Minerals and Geology approved an 1lOc permit application which included
many different sites. A[ [hat time each site should have been assigned a separate permit number, but this was not
done. After many different site inspections and correspondence between Division staff and Washington County
representatives over a period of time the Division believes that this situation has been resolved. In summary, this
is the current situation:
1. Petmit Number M-1981-125 was issued on August 27, 1981 under the site name of Gebauer Pit. This pit
was released during July of 1992.
2. Pit No. 2, the Shook Pit, was inspected on October 3, 2002, at [hat time the Division stated that, "if the
County can obtain a letter from the Landowner that he is satisfied with the current condition of Pit No. 2
the Division will release this pit." The Division received a letter from Jeremy Shook asking that the
County be released from [his pit. The Shook Pit is therefore no longer covered by any Division permit.
3. At the time of the October 3, 2002 inspection Larry Champ, the Washington County District #3 Road
Supervisor, stated that the current pit being operated under Permit M-1981-125 is the Drullinger Pit,
/\therefore Permit No. M-1981-125's pit name will now be referred to as the Dmllinger Pit.
(, 4. /Pit No. 5, referred to as the V.F. Smith Pit, is not currently not being mined by the county, but has been
~~G operated by someone in the last ten or so years. Since this site was permitted under M-1981-125 by the
County, and since it has not been reclaimed, the Division will hold the County responsible for the
reclamation. Also, since permit M-1981-125 is now assigned to the Drullinger Pit a new permit number
has been issued to the County for the V.F. Smith Pit-Permit M-1981-309.
5. Through a series of inspections from 1982 to 2002 the Division has determined that all the other site
locations originally permitted in 1981 under M-1981-125 were never disturbed of had been reclaimed
either by an operator or landowner or through natural processes. Therefore, Permit No. M-1981-125 now
covers only one pit, the Drulinger Pit.
The Division is enclosing a performance warranty for Permit M-1981-309 to complete the "clean up" of this entire
situation. Please have the performance warranty signed by an appropriate official, notarized, and return it to us.
