III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on Apri104, 2005 by Mike <br />Boulay of the DMG. There was no representative from Kerr Coal Company present during the <br />inspection. Weather conditions were cool and cloudy with a storm approaching from the west. <br />The site was partially snow covered. There was no precipitation at the time of the inspection. <br />Roads <br />The permanent light use road that accesses the site was muddy with drifted snow in some <br />locations. The light use road became very slick approximately one-half mile within the locked <br />gate. Therefore, access to the site was limited to perimeter azeas and Ponds E, F, and G due to <br />the drifted snow and slick road conditions. The surface facilities area was viewed from a <br />distance and there was no appazent activity at the mine site during the inspection. Perimeter <br />azeas of the site appeared to be well maintained and no problems were noted. <br />Hydrologic Balance <br />Site sedimentation ponds E, F, and G were viewed. Pond E was full and discharging cleaz water. <br />The surface of Pond E was frozen. Pond F was full and discharging slightly turbid water. Pond <br />G was retaining water but not dischazging. The surface of Ponds G and F were not frozen. No <br />problems were noted at any of the sediment pond locations. Road ditches and culverts were <br />mostly snow covered in the vicinity of Ponds E, F and G. Ditch PD3 was viewed from the <br />County Road and was mostly snow covered and flowing with a significant amount of runoff. <br />This ditch was stable and functioning as intended. <br />
