III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.ot observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on February 25, 2004. There were no compliance problems noted <br />during the overflight. The digital images were reviewed on February 27, 2004. There was no snow at <br />the site, although snow was present in areas around the loadout site. <br />Roads <br />The main paved haul road was dry and in good condition, as was the graveled east side road. There <br />was a slight black discoloration of the highway pavement at the main entrance but this did not appeaz <br />to be a problem. <br />Facilities <br />About two dozen rail cazs were on the Terror Creek Loadout tracks, although all but two railcazs <br />appeazed to be empty. A unit train with loaded railcazs was on the adjacent tracks, appazently <br />belonging to Bowie Resources. <br />There was a moderate amount of coal that was stockpiled on the facilities bench. No coal haul trucks <br />were unloading during the overflight. There were no signs of fugitive dust offsite. <br />The berm around the fueling station was intact. The berm on the outside edge of the facilities bench <br />also appeared to be functioning correctly. No problems were observed at any of the other facilities <br />azeas. <br />Hydrolo¢y <br />There was some ice-covered melt water in the east pond. The ice and water level was well below the <br />level of the primary dischazge tube. The pond embankment appeazed to be stable. <br />There were no signs of erosional gullying at the loadout site. ' <br />Topsoil <br />No signs of gullying were seen at the east and at the west topsoil stockpiles.
