Comments - Comoltance <br />Below are particular Issues with regard to any of the compliance Items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />Avat~abillty of Records <br />The ma~orlty of the records were present at the mine. The ones <br />which were identified as missing are as follows: <br />1) 1983 water quality monitoring records; <br />2) An engineer's certification of proper construction of the <br />sediment pond; and <br />3) A copy of the Federal coal lease. <br />Signs and Markers <br />` The permit area is fenced, but not signed. Also, the <br />Identification sign at the mine entrance has the old owner's name on it. <br />The operator Indicated that permit boundary signs would be erected and <br />that a new identification sign was being prepared. <br />Hydrologic Balance <br />Two problem areas were identified: <br />1) The upstream end of the culvert under the road at the mine <br />entrance 15 partially blocked and should be cleaned; and <br />2) The lower diversion ditch below the lower bench west <br />drainage outlet is partially filled .with sediment. This should <br />be cleaned out before drainage overtops the ditch and flows <br />off=site. <br />Revegetation <br />There was some evidence that cattle had been on the revegetated <br />topsoil stockpile, probably during the previous year. A section of the <br />permit boundary fence near the stockpile was down. The fence should be <br />repaired. <br />
