<br />• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-BO-183 <br />INSPECTION DATE Sanuary 15, 1998 <br />INSPECTOR'S INITIALS TAS <br />1. A site inspection was made of the Brannan Sand & Gravel Company Pit No. 29 located near <br />132nd & Nome Streets in Brighton. Present during the inspection was Mr. Fred Marvel of <br />Brannan Sand & Gravel Company. <br />2. Pit No. 29 is permitted for 145.5 acres of affected land with a financial warranty of <br />$89,435 in the form of a corporate surety. The designated post-mining land use is wildlife <br />habitat, lakes and backfilled areas with potential for residential or commerical development. <br />Completion of the reclamation plan will result in the creation of 2 lakes, 1 of 62 acres and <br />another of 38 acres. Backfilling will occur along both lakes to create potential residential <br />and industrial sites. The shores of the lakes will be sloped at a grade of 3:1 or less, <br />except for the adjacent backfilled areas which will be sloped at a grade of 5:1 to a depth <br />of 6 feet below the water line. Shorelines will be left somewhat irregular and some shallows <br />may be constructed for wildlife uses. <br />3. The operator is nearly complete with mining in the Phase 2 area and is beginning to strip <br />topsoil in the Phase 4 area. There are approximateley 70 acres currently disturbed. All <br />disturbance was found to be within the permit boundary. Although mining has been completed <br />in the Phase 1 area this inspector estimates that approximately 193,600 cubic yards of <br />overburden fill are needed to achieve the desired post-mining contours in the area to be <br />reclaimed to industrial/commercial use. The majority of the Phase 1 and 2 areas has been <br />partially reclaimed to a 38 acre lake. Grading and topsoiling is still needed for the north <br />and east shorelines of the lake. The main processing area for the minining operation is <br />located in the Phase 3 area and encompasses approximately 6.5 acres. Nearby are several <br />flatbed trailer loads worth of non-roadable mining equipment. Near the entrance to the mine <br />site, in the northeast corner of the Phase 1 area is an old non-roadable dragline and a large <br />truck scale with concrete foundation. <br />4. There are no wash ponds present or discharges from the mining operation. The operator <br />uses a "wet mining" method with dragline and allows the excavated sand & gravel to dry before <br />loading and hauling to the processing plant. The operator has obtained a temporary <br />substitute supply plan from the Office of the State Engineer to mitigate for evaporative <br />loss. <br />5. An entrance sign was posted and the permit boundary was marked as required by Rule <br />3.1.12. <br />6. There are weeds present, although none are considered to be noxious. <br />7. The Division has calculated a total reclamation cost of $413,400 in order to complete the <br />reclamation plan, based on the current and planned disturbance in all phases of the <br />operation. Attached is a copy of the reclamation cost and supporting calculations. This <br />cost is significantly higher than the existing financial warranty of $89,435. The Division <br />considers this matter to be problem that will require corrective measures by the operator <br />within a period of 60 days. Several corrective measures are available to the operator: Otion <br />1, submit a replacement warranty of $413,400 or a supplemental warranty of 323,965; Option <br />2, submit an application for an amendment to the permit which may result in more cost <br />effective mining ~ reclamation and a lower reclamation cost; Option 3, perform reclamation <br />to reduce the current reclamation liability; or Option 4, some combination of the above. <br />Please see page 4 for details. <br />
