III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />The purpose of this aerial inspection was to document the condition of the overall site. There has been <br />no claimed implementation of any part of the reclamation plan. Five aerial photographs were taken by <br />Harry Ranny, an Environmental Protection Specialist with the Division of Reclamation, Mining and <br />Safety (Division). They are on file at the Division. This visual review was conducted by Byron G. <br />Walker of the Division. <br />A number of subject items aze circled above as in compliance with the permit. This interpretation is <br />limited to the scale of the photographs. The roads seen are as permitted in permit documents. Two <br />sedimentation ponds (Ponds 1 and 2) are permitted. Pond 1 appears to contain water. Support facilities <br />aze as described in permit documentation. Two topsoil piles appeaz to be stable and protected. The site <br />is in general compliance with the permit. Conversion of the site from a coal load-out to a coal load-in <br />operation has been approved, but there has been no conversion activity. There are no specific fish and <br />wildlife requirements. There is no air quality degradation activity at the site. <br />The following comments are appropriate to the subjects so circled above. There has been no claimed <br />reclamation of any disturbed area at the site. There has been no backfilling and grading, placement of <br />topsoil, or revegetation accomplished at the site. There is a slide (in a railroad cut) that appeazs to have <br />arrested in the permit area, but this azea is not shown on the photographs. <br />This permit is in temporary cessation.
