III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of CDMG. This former underground <br />mine is reclaimed. Remaining buildings and structures are approved to remain as permanent <br />structures. Ground conditions on this day were soft ,but not muddy, and the weather was breezy <br />and mild. <br />Availability of Records <br />The public copy of the mine records is kept at the office of the county clerk at the Las Animas <br />County courthouse. The operator has recently brought records up-to-date and all required records <br />were easily found as detailed on the attached checklist. <br />Hvdroloaic Balance <br />The single sediment pond at the site was basically dry and appeared in good condition. Recent <br />rainfall did not produce runoff. The operator may want to consider cleanout of this pond to meet <br />the requirements of Rule 4.05.17 for permanent structures. Ditches and culverts site-wide were <br />found in good condition except as noted below. <br />Numerous maintenance items have been cited in previous inspection reports. They are as follows; <br />1. The south access road ditch should be regraded to design criteria <br />2. The silt fence below the topsail pile footprint should be repaired as needed <br />3. Siltation should be remove from watershed diversion ditch #4 <br />4. Siltation cleanout of the armored 100-year ditch section behind and east of shop <br />5. Straw bales at the west end of 100-year ditch should be repaired as necessary <br />Please review previous inspections for specific details. The operator should ensure that these <br />maintenance items are addressed prior to August 31, 2002. <br />Page 3 <br />
