III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the Coal Guich Mine was conducted by DMG staff from the Durango <br />Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The permit <br />was revoked over 5 years ago. Financial warranty was forfeited and utilized for final <br />reclamation. <br />Coal Gulch has been realigned, by the landowner or on behalf of the landowner, to direct <br />drainage to the culvert under Hwy 160. The realigned portion of Coal Gulch showed no <br />evidence of flow. Re-graded areas appeared stable. <br />Shallow water, approximately 0.5' depth, was impounded in a low-lying area located at the back <br />of the permit area. Numerous tracks of wildlife were observed near the impounded water. <br />Sediment pond was holding water, approximately 1' depth. Primary spillway outlet was not <br />located, assumed buried or destroyed by landowner grading activities. Portions of the <br />embankment outslope have also been steepened by landowner grading activities. <br />
