<br />MINE ID'# OR PROSPECTING ID # M-56-048 <br />INSPECTION DATE 3/16/99 <br />(Page 2) <br />OBSERVATIONS <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the Nicholson Pit conducted by Erica Crosby of the Colorado <br />Division of Minerals and Geology. Gene Jefferson and Willy Sanders representing Washington <br />County were present during the inspection. Weather conditions on site were cool and clear. <br />Ground conditions were dry. <br />The Nicholson Pit is located 3 miles northwest of Messex in Morgan County. The site is <br />permitted to affect 9.9 acres. A mining and reclamation permit was issued to Washington <br />County on May 22, 1986. <br />Gene Jefferson and Willy Sanders stated that Washington County has not recently mined from <br />the site. They believe that the landowner (Mr. Nicholson) has been mining from the pit. The <br />operator requested a transfer of permit and succession of operations form. A small screening <br />facility was located in the pit. Topsoil piles have been stored around the perimeter of the <br />pit. The south portion of the site has been reclaimed. <br />The area was surveyed using the Global Positioning System (GPS). The area of the pit was <br />surveyed, and the data was corrected using the Pathfinder Software. The pit disturbance is <br />currently at the maximum acreage allowed. If any new surface area is disturbed, the operator <br />may be mining outside the permitted boundary. This would be a possible violation of C.R.S. <br />34-32.5-109(1) or 34-32.5-116 (4)(i) of the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials. If the operator plans to expand the pit (for a maximum <br />disturbance to exceed 9.9 acres) , a 112 Reclamation Permit Application will need to be <br />submitted and approved by the Division. A copy of a 112 Permit Application is enclosed. <br />A mine identification sign was not posted on site. Rule 3.1.12 requires at the entrance of <br />the mine site, a sign shall be posted to include the name of the operator, a statement that <br />a permit for the operation has been issued by the Colorado Mined Land Reclamation Board, and <br />the permit number. Permit boundary markers could not be located on the northeast and <br />northwest side of the pit.
