III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The April inspection report noted that a segment of the cut slope road ditch on "G" Road, west of Pond 005 had <br />down-cut, and repair would be necessary, along with rock lining or other appropriate stabilization measures. <br />Operator recently regraded the ditch segment of concern, then seeded the section and installed turf <br />reinforcement mat as a protective measure. <br />Gravel excavated from a culvert outlet on the lower MEHR road and temporarily stockpiled nearby has not yet <br />been removed. The stockpiled gravel needs to be properly removed. <br />The inlet to Culvert F-3, on the MEHR along the north side of Pond 006 had been properly maintained, as <br />previously requested. <br />A berm had been properly constructed along a section of the Ridgeline light use road in the vicinity of Culvert <br />PM-10, as specified in the recently approved TR-60 (for abatement of NOV CV-2007-002). The purpose of the <br />berm segment is to contain disturbed area snow-melt runoff in the event that Channel PM-4C andlor the <br />roadside ditch are blocked by snow and ice or otherwise overwhelmed by snow-melt runoff. The berm would <br />direct such flow down the road and into Culvert PM-10. <br />Gravel surfacing had recently been completed along the permanent Ridgeline Access Road. <br />Installation of a series of water bars is warranted along the reduced width section of permanent Road <br />"L", to minimize concentrated flow from the north end of the road segment that has caused rilling on the <br />slopes below the road. Operator indicated that the water bars would be installed promptly. <br />Hvdrolopic Balance <br />All sediment ponds were checked, and conditions were as follows. Ponds 006 and 016 were discharging clear <br />water over the top of the riser. There was typical clear flow (approximately 15 to 20 gpm) out of the French drain <br />below the damaged 024 series wells, into Pond 016. Pond 016A contained a pool of clear water; surface <br />elevation of the pool was approximately 1 foot below the top of the spillway riser, no discharge. Pond 017 <br />contained a pool of clear water; surface elevation of the pool was approximately 3 inches below the top of the <br />spillway riser, no discharge. Pond 005 contained a pool of clear water, pool elevation approximately 3 feet below <br />top of riser, no discharge. Pond 009 contained pool of clear water; pool elevation 3 feet below top of riser; no <br />discharge. Pond 015 water level was just an inch or so below the top of the spillway riser, no discharge. One <br />beaver was observed in the pond. 015 spillway structures were clear and functional, however beavers have <br />dug a shallow excavation into the upstream side of the embankment, which will need to be watched to <br />ensure that further excavation does not affect the stability of the embankment. Trapping or other <br />measures to remove the beavers may be advised; Division of Wildlife should be contacted regarding <br />management options. <br />Final abandonment work associated with the damaged 024 Series monitoring wells below the Pond 016A <br />embankment is to be completed later this summer, in accordance with State Engineer directive. Operator <br />provided a letter dated July 26, 2007 detailing the work that will be completed in accordance with the State <br />Engineer recommended procedure, along with a commitment to provide an abandonment report and minor <br />revision to the permit addressing the abandonment and future monitoring of drainage from the French drain. <br />The minor revision to update permit narrative addressing the status of the 024 Series wells and future discharge <br />monitoring will be submitted following completion of the abandonment procedure. The small temporary soil <br />stockpile adjacent to the 024 wells is heavily infested with the noxious weed Canada thistle. The <br />infestation on the stockpile and adjacent areas that will be disturbed in association with the well <br />abandonmentlreclamation will need to be sprayed prior to project initiation, to avoid further spread of <br />.the weeds through movement of live roots and rhizomes during reclamation grading, <br />4 <br />
