<br />(Page 31 <br />MINE ID # OR PROSPECTING ID # <br />INSPECTION DATE 8/18/98 <br />INSPEC:TOR'S INITIALS W~I~ E <br />DOE recently imposed requirements appear to be in conflict with the existing Reclamation Plan for <br />the following issues: no allowance for closure or safeguarding of the venthole; no allowance for <br />backfilling and recontouring of approximately 80' portion of the cutbank or highwall for the portal; <br />no allowance for recontouring of portions of the access road; unknown allowance for recontouring <br />of portions of the waste rock stockpile underlying the 600 ton stockpile of low-grade ore; and no <br />allowance for establishment of vegetative cover for portions of affected lands. Therefore, it <br />appears that the operator will not be capable of completing the conditions. of the existing <br />Reclamation Plan necessary to attain release of warranties and termination of permit. <br />DMG has identified the following 3 options available for the operator: <br />1. Transfer the permit to the party desiring to utilize the permit area for mining purposes. <br />2. Modify the existing Reclamation Plan through the Technical Revision or Am~:ndment process <br />to address DOE desires in a manner which complies with the Act and Rules. Modification of DOE <br />requirements, as stated in DOE 8/20/98 correspondence, may be necessary. <br />3. Complete reclamation in accordance with the existing Reclamation Plan for affected lands not <br />addressed by DOE imposed requirements. Petition the Colorado Mined Land Reclamation Board <br />for reclamation of substituted land, as provided under Rule 3.1.2 and 34-32-11617-(g11111) C.R.S., <br />for affected lands addressed by DOE imposed requirements and therefore not reclaimed.
