III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection or the records check. <br />Roads <br />The Hubbard Creek road was dry and in very good condition, as was the mine site entrance road. The entrance <br />gate was closed and locked. The road to pond 5 was in good condition, Oxbow Mining has established a road <br />along the west side of pond 5 and, then, northward in order to construct methane de-gas wells for their mine <br />operations. The disturbance of this section of land had been transferred to Oxbow through a revision. <br />Hydrology <br />Pond 4 was dry. The pond embankment appeared to be stable. There is a lot of vegetative growth in the pond. <br />The pond spillways were functional. The reclaimed coal stockpile area that drains into pond 4 was well grassed, <br />although thistle in this area needs to be sprayed. The upland diversion ditch was well grassed and had sufficient <br />capacity. The road culvert leading to pond 4 was clear. <br />Pond 5 was also dry. The pond embankment was stable and the spillways were operational. The collection ditch <br />leading into pond 5 was well grassed and had enough capacity. <br />The north underdrain had a slow but steady trickle of water coming out of the pipe, while the other underdrains <br />were dry. The black plastic culvert pipe going down the reclaimed slope that brings upper bench runoff to the <br />pond 5 collection ditch was in place. <br />Signs and Markers <br />The mine ID sign was up on the front gate of the mine site. Also on the gate was the records location sign. <br />Surface disturbance markers were up around the disturbed area. <br />Reclamation <br />The reclaimed slopes and benches of the mine site were well vegetated. There were no signs of erosional gullies <br />or slope instability. There were no active seeps or wet areas on the reclaimed slopes and benches. There were no <br />problems noted with the reclaimed upper road. <br />Records <br />The records were in compliance, as documented on the attached records checklist.
