Simpson, P.E. <br />State Engineer <br />Pursuant to your recent inquiry regarding the Herman Feit Gravel Pit, DMG tt M-77-522, <br />this office has researched our files to determine the status of the water issues associated <br />with this operation. If the exposed groundwater associated with this site was Exposed as <br />a result of the mining of sand and gravel, the applicant, pursuant to C.R.S. 37-9C~-137 (11), <br />must obtain a gravel pit well permit. From our files it does not aopear that the aoolicant <br />has obtained such a oravel pit well permit. In addition, if the groundwater was exposed <br />after December 31, 1980, either a water court approved augmentation plan or a State <br />Engineer approved substitute supply plan, to replace the depletions to the stream system <br />resulting from open mining of sand and gravel, must also be obtained.
