Wakher
E>ecutroe Director
Hal D. Simpson, P.E.
State Engineer
Pursuant to your recent inquiry regarding the Herman Feit Gravel Pit, DMG tt M-77-522,
this office has researched our files to determine the status of the water issues associated
with this operation. If the exposed groundwater associated with this site was Exposed as
a result of the mining of sand and gravel, the applicant, pursuant to C.R.S. 37-9C~-137 (11),
must obtain a gravel pit well permit. From our files it does not aopear that the aoolicant
has obtained such a oravel pit well permit. In addition, if the groundwater was exposed
after December 31, 1980, either a water court approved augmentation plan or a State
Engineer approved substitute supply plan, to replace the depletions to the stream system
resulting from open mining of sand and gravel, must also be obtained. Again from our
files. there is no evidence that either the groundwater associated with the site was
exposed prior to December 31 , 1980 or that the applicant has aooroval of a plan to reolace
the deoletions to the stream system resulting from mining operations after December 31,
1980.
If you have any questions, please contact this office at (303) 866-3581 .
Sincerely,

Megan Sullivan
Water Resource Engineer
cc: Dave Nettles, Assistant Division Engineer
file
