III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the erforcement action. . <br />This aerial inspection was flown on Mazch 2, 2005. No compliance problems were observed during the <br />overflight. The digital images were received on Mazch 3, 2005 and reviewed on Mazch 7, 2005. <br />Roads. <br />The paved haul road was dry and in good condition, with no appearance of coal on the main highway. <br />The graveled east side entrance road was also in good condition. The east gate was open. The light use <br />road along the railroad tracks also appeazed to be dry and passable. <br />Hvdrology <br />There was a fair amount of standing water in the east sediment pond, although the water level was still <br />below the level of the primary discharge tube. The pond embankment appeared to be stable as were the <br />pond inslopes. The west side sediment pond appeared to be dry. There were no indications of erosional <br />gullying at the loadout. <br />Facilities <br />Loading operations were in progress during the overflight. There were about a dozen empty railcars on <br />site and at least half that already loaded. There were no railcazs on the main track. Also there was not a <br />lot of coal stockpiled on the facilities bench. No coal haul trucks were unloading coal. There were no <br />signs of fugitive dust offsite due to the coal operations at the loadout. <br />There did not appeaz to be any problems with any of the facilities, including the office, shop building <br />and loadout structures. There was a fair amount of coal waste stored temporazily on the east side of the <br />facilities bench. <br />Topsoil <br />No erosional problems were noted at the east and west topsoil stockpiles. Collection and diversion <br />ditches appeazed to be functional. Vegetative cover was adequate. <br />c:/word/ten•or/insp0305 <br />
