A site inspection of the Mackey Mine was conducted as part of the Division's 4-year inspection program. Present during <br />the inspection were George Often and Jim Bateman. The Mackey Mine is located 12 miles from Black Hawk at an <br />elevation of approximately 10,000 feet. <br />2. The Mackey Mine is an underground hard rock mine permitted for a total surface disturbance of 0.35 acres. The <br />reclamation plan specifies backfilling of any remaining waste rock into the portal, securing of the mine portal, finish <br />grading of surface facilities, and reseeding of surface facilities. The Division assumes that any trash and non-roadable <br />mining equipment remaining at the time of final reclamation will be removed from the site. The operator has posted a <br />financial warranty of $1,000. The site will be reclaimed to forest land. <br />3. According to Annual Reports filed by the various operator's of the Mackey Mine, the last mining activity at the site <br />ceased in October 1991 and had consisted of a minor amount of underground development, mining and milling of <br />approximately 100 tons of ore, and metallurgical testing of such ore. Other previous mining activities at the site occurred <br />during 1985 and 1986 resulting in a waste pile of an estimated 7000 tons. <br />4. There has been no change in the condition of the mine site since the last inspection by the Division conducted on July <br />24, 2000. The mine is currently not being operated. There is no visible waste rock present and only a minimal amount of <br />non-roadable mining equipment. Based on the disturbances noted, this inspector finds the existing financial warranty to <br />be adequate to complete reclamation. <br />5. George E. Often is the current permittee and operator of the Mackey Pit via approval of a Succession of Operator's <br />(SO-2) by the Division on August 24, 1998. It is the Division's understanding that waste material has been removed <br />offsite, and used in the manufacture of bricks to be used for low income housing projects. <br />6. It is unclear whether the operator's current activities are more than or less than 180 days per year. Temporary <br />Cessation should be applied for if the operator intends to operate the Mackey Mine via extraction, milling, processing of <br />on-site materials, or other mining activities for less than 180 days per year. Since the status of the operation is unclear, <br />the Division considers this matter to be a problem that will require corrective actions. The operator will need to clarify the <br />status of the operation, and if necessary submit a Notice of Temporary Cessation in conformance with the requirementr of <br />Rule 1.13.5 on or before July 30, 2004.
