,T ~ <br />1 •,~ <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />On March 3 a partial inspection was conducted at the New Elk Mine. Present at the <br />inspection was Ralph Lopez representing the mine. The weather was cool and clear. The <br />past several days have been snowy and very cold. The sun was melting some of the snow <br />in the exposed areas. Most of the inspection dealt with discussing past permitting issues, <br />designs, current projects and future objectives of the mine. <br />A general tour was made of the mine and ditches and culverts were checked for <br />functionality. No ditches or culverts were measured. The mine has recently maintained <br />many of the ditches <br />The inspection started at the refuse disposal area. The road along the east side of the pile <br />had its ditches cleaned and embankments dressed up. The upper diversion ditch recently <br />installed on the west side of the RDA was walked to the first drainage. It doesn't look like <br />water has flowed in this ditch yet. The operator will submit a revision to relocate the <br />conveyor. At its present location the grade of the pile is getting too steep so the conveyor <br />will be routed further east. The current lift has about 15 feet to go before another terrace is <br />made. The operator discussed the NOV that was issued for the riprap channel. Areas too <br />rocky for topsoil removal were noted. <br />Coal stockpiles were being depleted. The mine is currently moving the longwall. The <br />ditches and culverts around these piles were in good condition. <br />Comments, New Elk Inspection, page I of I <br />
