III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Carbon Junction Mine for the month of October, 1999 <br />Availability of Records: The records were inspected and found to be in disorder. Please insure that <br />all records are properly filed and that required pond and NPDES monitoring and records are <br />submitted. If the record keeping is not improved and missing and delinquent files located and/or <br />updated, then enforcement actions will be necessary. Proof of insurance is required, however, <br />the only form that could be located indicated that the insurance has lapsed by over a year. <br />Hydrologic Balance: All ditches and ponds were inspected and found to be in compliance, both ponds <br />were dry, well vegetated and capable of functioning as designed. All culverts were clear and capable of <br />functioning as designed <br />Excess Spoil and Development Waste : Topsoiling of the waste pile is held in abeyance until the status <br />of the reclamation efforts is made. <br />General Mine Comaliance: The site has apparently stopped its reclamation efforts and no clear plan <br />to either mine coal or reclaim the disturbed areas exists. There were no problems noted during the <br />inspection with the exception of the poor conditions of the records. <br />
