s <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A complete inspection of the Terror Creek Loadout was completed by <br />Christine Johnston of the Division. Please note this complete <br />inspection was performed for first quarter 1995. Kelly Fritzler of <br />TCC did not accompany me during my site inspection but was <br />available to discuss upcoming permitting and maintenance items. <br />The weather during the inspection was clear and warm. <br />Availability of Records <br />Records for the loadout were reviewed at the mine office. Please <br />see the enclosed records checklist for comments on the records <br />reviewed. <br />HvdroloQic Balance <br />Mr. Fritzler informed me that he is planning to hire Beaver's <br />Construction to clean out all ditches and culverts in the next few <br />weeks as part of spring maintenance. Mr. Fritzler informed me that <br />the area received a fairly significant amount of moisture the <br />previous week and with the warming temperatures, runoff was high. <br />There was no evidence of failure of any portion of the sediment <br />control system. The first quarter pond inspection report noted <br />that the water level in the sediment pond was at the invert of the <br />primary spillway. At the time of the inspection the water level <br />was approximately one foot below the primary spillway. The pond <br />did not discharge. The dugout pond was dry. All silt fences <br />located in the SAE was inspected. The first quarter pond <br />inspection report noted that some of the silt fences required <br />repair. All silt fences were in good condition at the time of the <br />inspection. The concrete sump located at the belt on the southwest <br />side of the facilities requires maintenance. There was no water in <br />the sump, so sediment should be easily cleaned out. <br />Support Facilities <br />Mr. Fritzler informed me that TCC was submitting a revision to <br />expand the shop building approximately 40 feet. To expand the <br />shop, the water line to fill the water trucks will need to be <br />rerouted and some of the hillside adjacent to the building will <br />need to be salvaged. In addition, TCC is planning to seal the <br />ground water well currently in use for office water, due to the <br />poor quality of the water. They are planning to drill a well in an <br />old orchard next to the topsoil pile on the west side of the permit <br />area. TCC is currently working with the Division of Water <br />Resources and will provide us with a revision once water Resources <br />has approved the relocation. TCC has begun to accumulate sediment <br />clean-out. Care should be taken to ensure that this material is <br />not pushed into the sediment pond. One of the barrels on the <br />
