III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Bazbe of Mountain <br />Coal Company represented the operator. The ground was dry. The inspection focused on methane <br />drainage wells in the West Bench and West Flatiron areas. Photos taken during the inspection are <br />attached at the end of this report. With the operator's consent, this report was issued from the Denver <br />office of DRMS. <br />Roads <br />Construction activity continues on the extension of the Sylvester Gulch road that was approved in TR- <br />99. Trucks were hauling fill material along the road. Silt fence was in place where fill material has <br />been placed in the road embankment. <br />Support Facilities <br />Methane drainage wells were inspected in the West Flat Iron area, including the following well sites: <br />15-08, 20-31, 20-O1a,20-3619-02, 1-18-42, 24-06, and 24HG2XCE3XC. Mudpits and site regrading <br />had been completed at all older sites. The mudpit at one site was drying out and has not yet been <br />backfilled. All well sites inspected are gently sloped to provide positive drainage toward the road. No <br />weed or erosion problems were found at any of the well sites. Silt fence was in place for sediment <br />control on the active drill pad. A diverse cover of grasses, forbs, and woody shrubs is beginning to <br />develop on the older sites. The one-year old reclamation of the West Flat Iron Road appeared in good <br />shape as seen from a distance. <br />Topsoil <br />The topsoil stockpile was properly marked at the active drillsite 1-18-42 and at wells drilled in 2005-6. <br />Topsoil was being spread at the recently reclaimed 24HG2XCE3XC methane drainage well. <br />Reve2etation <br />The operator has a weed spraying crew working full-time this summer. Thistle and whitetop appeared <br />to have been sprayed at several locations seen during the inspection. The operator's representative <br />pointed out that one of the next azeas to be sprayed is along the light-use road above Shaft 3 where <br />there is a patch of thistle. <br />Air Resource Protection <br />A water truck was spraying the West Flatiron road for dust control during the inspection. <br />3 <br />
