III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />At 8 50 a.m., September 12, 1991 a complete inspection was <br />conducted at the Bear 1,2 & 3 Mines. This inspection was an <br />Office of Surface Mining (OSM) oversight inspection. The <br />inspector representing OSM was Russ Porter and the inspector from <br />MLRD was Randy Price. During the inspection the weather was <br />mostly cloudy. Recent rains had left the ground wet and some <br />places were muddy. Representing the mine was Basil Bear. <br />Records checked and some minor deficiencies were noted. The <br />wording in the pond certification was somewhat ambiguous. The <br />pond was certified to be built as designed but the certification <br />did not reference the application page that contained the plan. <br />The MLRD permit expires in July 1992. <br />The inspection proceeded to the Haul Road. The road was well <br />maintained. A front end loader had recently cleaned the sediment <br />trap located at the bottom of the haul road. Ditches along the <br />road were in good condition. The entrance sign to the mine was <br />located at the bridge. The operator was advised to place the si%n <br />200 feet Up the road at the public entrance to the permit area. <br />The inspection continued to the sediment pond. The pond still <br />contained the cattail island. This year has been wetter than <br />normal and the mine was only able to clean the edges with a <br />backhoe. The riprap on the emergency spillway was covered with <br />soil and vegetation. Also the spillway may have been run over <br />with a backhoe. The mine should make sure that the spillway is <br />maintained to meet design capacity. <br />The inspection preceded to the flood control dike. The dike was <br />well vegetated and stable. The fence around the outside of the <br />dike was fenced and marked with disturbed area perimeter markers. <br />The area along the eastern segment of the dike was not marked but <br />a stake was found. The mine should make sure the sign is replaced <br />in this area. <br />The equipment storage was in good condition. All the drums in <br />this area were empty. The solid waste storage area was clean and <br />working effectively. The ditch that comes off the portal access <br />road was clear and functioning. The portal access road was in <br />good repair. <br />The fuel storage area was clean and well bermed. There were no <br />spills. <br />The Bear Mines #1 & #2 were inspected. Perimeter markers <br />delineated the affected area. Both mines do not have an entrance <br />
