Ili. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion. of observations.made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. It was snowing in the higher elevations during the inspection. <br />East Mine <br />The front gate was locked and the mine ID sign was up. However, the operator has new signs and will <br />be installing them shortly. Although some rocks had fallen onto the roads, the roads at the east mine <br />were passable. Rocks also fell into the road ditches leading from the crusher/screener bench up to the <br />portal bench but the ditches presently have sufficient capacity. Other ditches and culverts were clear <br />and functional as well. There were no erosional problems or slope instability problems at any of the <br />benches. The west side of the West Ridge waste pile was clear of snow. There was a good vegetative <br />cover on the waste pile and the collection and diversion ditches had sufficient capacity. No slumping <br />was observed at the waste pile. Surface disturbance markers were up around the site. <br />Run-of--Mine (RO Stockpile <br />Most of the site was covered in some snow, although the snow was beginning to melt on top of the <br />pile. The road was passable but wet or snow covered. Road culverts and ditches were functional. There <br />was water in the sediment pond to within 1 foot of the gated primary spillway. Surface disturbance <br />markers were present. The mine ID sign was up as well. <br />West Mine <br />Most of the backfilled portal bench area was covered in snow. There were no signs of slope instability <br />or erosional gullies with the backfill. The two sediment ponds had ice-covered snowmelt water in them <br />but only to within a couple feet of the primary discharge tube levels. Pond embankments were snow <br />covered but appeared to be stable. The road to the West Mine was plowed but the road up to the West <br />Mine.fan site was snow covered and was not tiaveled. The mine ID sign ai the West Mine has fallen <br />down but the operator is replacing ali of the mine ID signs soon. <br />Unit Train Loadout <br />All three entrance gates were open and mine ID signs were up. There were no problems with the <br />sediment control system. Collection and diversion ditches had sufficient capacity. The sediment pond <br />had no standing water in it.
