The pit was active at the time of the inspection. Mr. Heifner represented the operator during the <br />inspection. <br />There was no ID sign identified for the operation. This is a compliance problem that will be included on Page 3 of his report. <br />This request for partial acreage release was triggered by the identification of a area of overlap of the permit area of the Coal <br />Creek Resource operation with that of the Posco, Inc. Pit #3 (Permit M-1982-166) which is located to the immediate east. In <br />addition to the overlap of these two permit areas, the Coal Creek Resource permit area also overlaps the area of operation of <br />an Owens Brothers concrete batch plant which is also located to the immediate east and on a commercial development lease <br />secured from the'itate Land Board. Although these areas of overlap are involved in the release request, Centennial Materials <br />has also requested the release of other portions of their permit area located in the same general area. <br />The areas proposed for release and the revised permit area boundary were examined in company with Mr. Heifner. Most of the <br />area to be eliminated from the Coal Creek Resource permit area is undisturbed by mining activity. Although there was surface <br />disturbance in the areas of overlap proposed for removal from the Coal Creek Resource permit area, that surface disturbance <br />was not the result of Centennial Materials' mining operations. As a result, the Division will approve the release of the acreage <br />requested by the operator if proof of receipt of notice of the release request by the owner of the land is provided. Proof of <br />receipt of notice to Arapahoe County has been provided. <br />Neither the permit area boundaries nor the boundaries of the affected area are marked for the Coal Creek Resource operation <br />in the areas wherE~ the release inspection was focused.
