III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />warrant repair work and are noted on the 2006 Rill and Gully Survey Map, which was recently completed and <br />submitted to the Division. <br />Settling Cracks were noted in a couple locations that are not depicted on the referenced map. These <br />locations will need to be checked and regrded as warranted. A relatively minor settling crack feature <br />trending north/south for 60 feet or more was noted on the east facing graded slope a short distance to the <br />southwest of the large ridgeline slide referenced above. A larger settling crack was observed approximately 1/3 <br />of the way up the steep south facing final highwall slope in the 005-E1 Gulch watershed. The crack is located in <br />the area of extensive soil roughening; at its largest extent near the west end, the crack is 4-6" wide and at least 4 <br />feet deep, with a vertical scarp of 1 foot or more. <br />Drainage channel erosion had been delineated in numerous locations on the survey map, and it was apparent <br />that in many of these locations, grading and riprap installation had been recently completed. Thorough checks <br />will be made at a later date. Hillslope gullies were also delineated in various locations on the survey map, and it <br />appears that much of the hillslope gully repair work remains to be completed. These repair areas will be more <br />thoroughly checked later in the field season. <br />Revecetation <br />Extensive acreages were revegetated in 2004 and 2005. Most of these areas exhibit early stages of vegetative <br />succession, with the annual cover crop prominent in 2005 seeded areas and various annual fortis prominent in <br />2004 seeded areas. Seeded perennials are becoming established in most of the areas seeded in 2004, and <br />perennials have recently germinated in several of the 2005 parcels. The noxious weed Canada thistle is present <br />in various locations across the mine site, with dense patches in some areas. A contractor was on site spraying <br />thistle during the inspection, and many of the patches observed exhibited symptoms of recent herbicide <br />application. The dense infestation of black henbane noted in the 005-E1 watershed in 2004 appears to have <br />been successfully controlled; only a few scattered individual plants were observed. <br />More detailed evaluation of revegetation success will be undertaken later in the growing season. <br />Slides and Damage <br />A repair plan for the ridgeline pit slide described in the previous inspection report has not yet been submitted, <br />and repairs have not been initiated. <br />A complete technical revision application slide remediation plan addressing regrading, drainage <br />installation, vegetative stabilization, and other measures as warranted to ensure long gterm stability will <br />need to be submitted to the Division by July 1, 2006. The revision shall include a timetable for <br />completion of major tasks and the entire project. Remedial work shall be completed by October 1, 2006. <br />6 <br />
