III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Revegetation efforts appeazed adequate with vegetation firmly established throughout the <br />bond release area. Rabbitbrush and sagebrush area present and there was evidence of <br />sage regenerating on the lower slopes of the site. On the north side of the site, in some <br />locations mosses were present. <br />Although not required of the Pre-Law area, Quantitative sampling was conducted in July <br />2005 by ESCO Associates. The results were provided in Attachment D of the bond <br />release application and the 2005 Revegetation Monitoring Report. A summary of the <br />results is provided below: <br />Cover: Total average vegetation cover was 34 percent. For herbaceous vegetation, total <br />average cover was 31.2 percent. Average species density was 10 species per 100 sq.m. <br />Production: Total herbaceous production was 1,631 pounds per acre. <br />Woody Plant Density: Total average woody plant density was 890 stems per acre. <br />Excluded Areas <br />Two locations were identified along the eastern perimeter that will be excluded from the <br />bond release. The first is in the location where the lower end of the channel being <br />constructed as part of the Old Wolf Creek Pit Remediation Plan (Channel PL-1). This is <br />part of the mitigation for the 67.4 acres described above. The 67.4 acres is situated <br />immediately adjacent to the bond release area. The channel will provide drainage from <br />the Old Wolf Creek Pond (see DRMS inspection report dated 08/24/06 for details of the <br />Old Wolf Creek Pit). The lower end of the channel has been extended into the bond <br />release area. The channel is approximately 1,800 feet long and will direct runoff from <br />the bowl area of the Old Wolf Creek Pit into the Pond 002 watershed. The disturbance <br />extending into the bond release area that is associated with this channel was measured to <br />be approximately 80 feet wide by 440 feet long. This was recalculated more accurately <br />using AutoCAD back at the Seneca Mine office and determined to be 1.13 acres. The <br />channel has been graded and shaped but the lining material has not been placed. The <br />disturbance on the sides of the channel are final graded but will need to be seeded this <br />fall. The disturbed area that will be excluded from this bond release is shown in <br />Photograph Number 7. The 1.13 acres are adjacent to and will be included with the 67.4 <br />acres of the Old Wolf Creek Area with regard to future bond releases. <br />The second area that will be excluded from the bond release is a dozer scar that was left <br />from the Old Wolf Creek Pit grading work recently completed.
