III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />The inspection began at the northeast corner of the bond release area at the top of the <br />existing road that accesses the Pre-Law lands from the north. The eastern perimeter was <br />walked followed by two traverses in an east to west direction from the top down to Road <br />E1; a final traverse was made along the central portion of the bond release area from <br />north to sputh above Road E1. The Division's observations and findings are described <br />below under the following broad headings: Grading & Site Stability, Topsoil, <br />Revegetation, and Excluded Areas (not meeting the requirements for bond release). <br />Gradine & Site Stabilit <br />The reclaimed Pre-Law lands included in the bond release area were stable with no <br />significant erosion noted. The site was graded to be appropriate for the post-mining land <br />use, which includes a primary postmining land use of livestock grazing and a secondary <br />use of wildlife habitat. Cattle were seen grazing throughout the Pre-Law Area. The <br />steepness of representative slopes was field measured with an inclinometer along two <br />traverses from the top of the bond release area down to Road El . Slopes measured <br />ranged from 20% to 42% with the steeper terrain being at the higher elevations of the <br />bond release area. There is good topographic diversity with a significant amount of hilly <br />terrain. The reclaimed landform is stable and slopes are not too steep to be traversed by <br />livestock. Photograph Numbers 1 & 2 provided in Attachment 1 at the end of this report <br />show cattle grazing on the stable well vegetated reclaimed area. <br />Surface runoff control appears adequate with no significant rills and gullies noted <br />anywhere in the bond release area. There are no post-mine drainage channels constructed <br />in the bond release area with exception of the extreme lower section of PL-1 described <br />below under the discussion of excluded areas. There are no sediment ponds and no stock <br />ponds within the reclaimed 259.1 acres. Surface runoff all eventually drains to the <br />Wadge Impoundment (Pond 002) which is not included in the Pre-Law Area and has <br />been approved by the Division as a permanent structure. <br />There were three separate sections of haul road that traversed the 259.1 acres requested <br />for bond release. Two of these have been fully reclaimed. These former haul road <br />sections are stable with no erosion and have adequate vegetative cover. Amain section <br />of haul road traversing the central portion of the area is shown in Photograph Number 3. <br />The lower haul road which still crosses through the Pre-Law lands was retained and <br />subsequently used during the permanent program time frame and was designated as Road <br />EI. This road has been approved by the Division as permanent and was not part of this <br />bond release inspection. <br />
