III. COMMENTS -COMPLIANCE <br />~u~e <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />taken during this inspection aze tabulated below. Several permanent post-mine channels were <br />designed and constructed as road ditches including PM-9, PM-15, and PM-17 along Road El and <br />PM-13 along a portion of the South Road. All of these post-mine drainage channels functioning <br />as road ditches were stable and well constructed. In addition to the pennanent channels, the <br />following existing culverts were evaluated as permanent structures and will remain aspost-mine <br />features: 2A, 2AA, 3A, 9A, 12A, 13A, 15A, 18A, 19A, 24A, 29A, 30A, 32A, 33A, 45A, 47A, <br />62A, A3, and A5. Culverts site wide were cleaz of sediment and debris and functioning as <br />intended. All proposed permanent access roads site wide were generally in good condition and <br />maintained. Two azeas were noted where ongoing maintenance will be needed. The first is along <br />a portion of the South Road where a significant gully is forming in the location of the road ditch <br />and the second area is the northern section of Road El where substantial ruts in the road aze <br />forming. These locations have been described in previous inspection reports. <br />In accordance with Rule 2.05.5(1)(b), SCC has submitted letters from the landowners (State of <br />Colorado land Boazd, Grassy Creek Holding Company, LLC and Seneca Coal Company) <br />requesting that the corresponding sections of roads within their property boundaries be left open <br />for future use. Upon approval of Technical Revision No. 37, the compliance requirements of <br />Stipulation No. 32 will have been met and the stipulation will be terminated. <br />Backfill & Gradine <br />The majority of the reclaimed areas of the mine site were stable with adequate surface water <br />runoff control. Observations were made throughout the inspection with regazd to approximate <br />original contour and erosional stability of the reclaimed landscape. Lazge portions of the mine <br />site were viewed by walking all of the post-mine drainage channels and by accessing the highest <br />elevation points in the former Wolf Creek Pit and Wadge Pit areas.
