III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Arness McGriffen Mine was conducted by DRMS staff from the Durango <br />Field Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The permit <br />for the Arness McGriffen Mine was revoked and bond forfeited in May 1989. The $13,750 financial <br />warranty was utilized for final reclamation. <br />Public access to the site and to nearby state lands is controlled by the Colorado Division of Wildlife, by <br />locked gate. The gate and southern portions of the access road, located near Hwy 160, were not <br />inspected. The region has experienced significant precipitation throughout July and August. <br />Evidence of recent vehicle traffic, campfire, shooting of firearms and illegal dumping was observed at <br />the mine bench area. Backfilled slopes above the bench appeared well vegetated and stable, no <br />evidence of slumping, sliding or excessive erosion was observed. Vegetative cover appeared well <br />established, dense and diverse for reclaimed areas not impacted by vehicle traffic. However, areas <br />impacted by public use exhibited sparse vegetative cover and significant erosion. Gully erosion had <br />developed along the access road sufficient to undercut one of the posts for the guardrail. <br />Three photos accompany this report <br />
