III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This partial inspection of the Arness McGriffen Mine was conducted by DRMS staff from the Durango
Field Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. The permit
for the Arness McGriffen Mine was revoked and bond forfeited in May 1989. The $13,750 financial
warranty was utilized for final reclamation.
Public access to the site and to nearby state lands is controlled by the Colorado Division of Wildlife, by
locked gate. The gate and southern portions of the access road, located near Hwy 160, were not
inspected. The region has experienced significant precipitation throughout July and August.
Evidence of recent vehicle traffic, campfire, shooting of firearms and illegal dumping was observed at
the mine bench area. Backfilled slopes above the bench appeared well vegetated and stable, no
evidence of slumping, sliding or excessive erosion was observed. Vegetative cover appeared well
established, dense and diverse for reclaimed areas not impacted by vehicle traffic. However, areas
impacted by public use exhibited sparse vegetative cover and significant erosion. Gully erosion had
developed along the access road sufficient to undercut one of the posts for the guardrail.
Three photos accompany this report
