III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments Include discussion of observations.made <br />during the inspection. Comments also describe any enforcement actions-taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection, flown on February 25, 2004. The digital images were reviewed on <br />February 27, 2004. There were no compliance problems noted during the overflight. There was very <br />little snow at the lower elevations but the amount of snow cover increased with altitude. <br />Unit Train Loadout <br />There was a unit train with empty railcars, but no locomotives, sitting at the spur line at the train <br />Loadout. However, no coal haul trucks were on site. There was almost no snow on the ground. The <br />three entrances to the Loadout site were open and the paved and graveled roads were dry. No fugitive <br />dust problems were seen at this site. <br />East Mine <br />There was no activity at the East Mine and has not been for some time. There was snow cover on the <br />flat portions of the site and on the roads, but the south-facing slopes were cleaz of snow. There were no <br />signs of erosional gullying or slope instability with any of the cut and fill slopes or the highwall. <br />Only the south-facing slopes at the West Ridge waste pile were &ee of snow cover. There was no <br />gullying or slope instability at the West Ridge waste pile. The pond was also snow covered. The pond <br />embankment appeazed to be stable. <br />Practically the entire run-of--mine stockpile azea was covered in snow, including the pond and haul <br />road. The pond embankment appeared to be stable. No problems were observed at the site. <br />West Mine <br />The entire West Mine site was.covered in snow. The Sylvester Gulch road and the mine road leading <br />to the West Mine were, however, cleaz of snow.
