(Page 2) <br />MINE ID # OR PROSPECTING ID # M-2001-085 <br />INSPECTION DATE 11/06/02 INSPECTOR'S INITIALS ESC <br />OBSERVATIONS <br />This was a pre-operation inspection of the 124th Estates Sand & Gravel Mine, Permit No. M- <br />2001-085 conducted by Erica Crosby of the Colorado Division of Minerals & Geology. Les <br />Ewegen of Adams County RV Park, LLC, dba 124`° Estates Partners and Scott Keen were present <br />during the inspection <br />Adams County RV Park, LLC, dba 124`h Estates Partners filed a permit amendment application on <br />October 8, 2002. The amendment application adds an additional 1.51 acres to the site in the <br />form of a haul road. It will be used as a private access road connecting the 124`° Estates <br />Sand and Gravel Mine to 120`h Avenue. The original application filed in 2001 included an <br />access route via an existing driveway off 124`h Avenue. However, approval from Adams County <br />requires access from 120`h Avenue rather than 124`h Avenue. <br />As an interim measure, the DMG recently approved a 110 application for a temporary access <br />road from the Henderson Water Ski Lake (Permit M-2002-107). It is the Division's <br />understanding that this road was approved via Adams County for a 45-day period to allow the <br />operator to obtain approval from the DMG for this amendment application. <br />The mine site is located approximately 1/2 mile of the South Platte River in Henderson, <br />Colorado. The proposed access road would begin at 120`h Avenue and proceed northwest to the <br />mining operation. The road would proceed through an open field consisting of fallow cropland <br />and annual weeds. The road would stay 100 feet away from the Hanson's property line. <br />Construction of the haul road should have no impacts on the Hanson's fence or structures, <br />since minor excavation work is required. The return route will proceed in the same fashion, <br />with exception to the exit on 120` Avenue. The exit route will veer to the west through the <br />Shibli property. <br />The exit route may have some impacts to adjacent structures where it crosses two irrigation <br />ditches and structures on the Shibli property. The irrigation ditches carry water from the <br />Fulton Ditch to the Hanson property. The operator stated that culverts would be placed where <br />the road crosses irrigation ditches to allow surface water rights to be protected. in terms <br />of the structures on the Shibli property, the operator will need to provide a notarized <br />agreement between the owner of the structure and the operator or provide an engineering <br />evaluation as required by Rule 6.4.19. If agreements are forged with persons having an <br />interest in the structures, the agreements must be drafted in the format required by Rule <br />6.4.19 and Section 34-32.5-115(4)(e), C.R.S. <br />The Division has received one objection to the amendment application from Bob and Terrie <br />Hanson. Three letters in total have been written by the Hanson's and contain the following <br />objections/concerns: <br />The proximity of the drive road to the house...the foundations probably will not take the <br />poundings and vibrations of hundreds of semi trailers every day for a year. <br />The driveway is an easement of record on our deed...safety concerns and how it will <br />remain accessible. <br />Possible impacts to irrigation ditches. <br />The well is located on the SE Corner of the Shibli property, is water quality <br />addressed? <br />Possible impacts to livestock. <br />Possible impacts to septic system. <br />Possible impacts to Shibli structures and infrastructures to the houses. <br />Items #3, 4, 6 and 7 are issues that are under the jurisdiction of the DMG and the Mined Land <br />Reclamation Board. The operator will need to respond to these issues before the Division can <br />make a decision regarding this application. The remaining issues are normally addressed by <br />the local county government during the special review process. <br />Since the date of this inspection, the operator has withdrawn this amendment application (AM- <br />01) and has re-filed the proposed haul road as a 110 application (File M-2002-113). <br />
