<br />(Page 2) <br /> <br />MItE ID 1 OR PROSPECTING ID 1 11-8011 <br />INSPECTION DATE 10-04-94 INSPECTOfl'S INITIALS SSS <br />OBSERVATIONS <br />fiis was a routine Division of Minerals and Geology IDNS) inspection of the Hillyer Gravel Pit leafed at the southeast corner of the City of Silverton, <br />Colorado in San Juan County. The site is located within the annual flood plain of the Upper Anivas River. According to the Operator's Representative, <br />Kevin Padrick, the site is often demolished in the winter by an avalanche. The site is located below a large avalanche chute. Because of the site <br />location, to protect the drainage system from pollution, and to minimize unsi~tliness of the mine site, the operator must clean up and dispose of, or <br />properly store all refuse and waste materials strewn about the site. This includes but is trot lieited to non-working machinery, scrap metal, trash, <br />pallets, drums, cable, pipe, wood, batteries, conveyor belt and tires, all of which were observed on-site. Same of this trash is currently piled on the <br />western edge of the pit which is also the river bank when flaw rates are high. <br />Two areas were noted where water was being pumped from the river, one at the cement plant and one at the crusher site. The penit does not indicate that <br />any water ri¢~ts have been secured for this consumptive use or that a penit for discharge of this water has been obtained. The operator must provide <br />evidence of right to consume this water or refrain from pumping water from the river wtil such rights have been established through the State Engineers <br />Office. Discharge of water from processing operations on site must cease until the operator provides evidence that the Colorado Departaent of Health - <br />Nater Duality Control Division has been contacted regarding application for an HPDES permit. If the pumping of water from the river, and the reWrn of <br />processing water to the river are operations that will no longer take place at the mine then the pumps should be removed and the penit should be revised <br />to indicate that coritaent. <br />There is no indication in the permit that a cement plant would be part of the mining operation. The operator needs to submit a technical revision W their <br />permit to incorporate the cement plant or remove the plant and all associated items, irroluding the cement mixer trucks, from the site. If these items <br />are Prot removed from the site they will 6e included in the reclamation band amount. <br />In response to the passage of Senator Bil] 91-171 in 1991, which removed the (5000.00 financial warranty cap for 110121 mining operations, the Nined Land <br />Reclamation Board directed DM6 to begin recalculation and adjustaent of reclamation bonds for all permitted 11012) operations. This process is ongoing. <br />Review and recalculation of the frond for your operation will take place over the next few weeks. A copy of the recalculated estivate will be forthcoming. <br />fie Corps of Engineers was contacted, concerning wetlands, during the penitting of this vine. Due to the recent changes in regulations and due to the <br />obviously high iron content of the gravel at this mine, the operator should contact the Corps of Engineers to verify that the vine remains in compliance <br />under their jurisdiction. <br />Kevin Padrick did indicate during this inspection that he was in the process of obtaining NPDES, 404, Stormwater pewits and would also contact the CDH <br />Air Duality Control Division concerning an Emissions Permit. <br />fie original pewit yaps included, as landmarks, streets that were never constructed in the town of Silverton. Therefore, it is not possible to determine, <br />from these maps, whether or not the operation is within it's approved penit boundaries. The operator should provide evidence to clarify this siWation, <br />specifically, explain why the site does trot line up with the streets indicated on the penit map. <br />On August 1, 1991, a rule became effective which specifies: <br />At the entrance of the sine site the operator needs to post a sign, which is clearly visible fray the access road, with the following: <br />(a) The nave of the operator, <br />Ib) Specify that a DM6 penit has been obtained, and include; <br />Ic) The Permit Number. <br />The boundaries of the affected areas need to be marked by monuments or other markers that are clearly visible and adegate to delineate such boundaries. <br />
