ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~~-~ 9a~-ns;e <br />INSPECTION DATE: 3Wns INSPECTOROS INITIALS: ~_ <br />OBSERVATION <br />The Division conducted a compliance inspection of the site at the request <br />of the operator. The operator had been given until 2/28/05 to address some <br />issues raised during the after the November 2004 inspection. During that <br />inspection the Division had requested a new map of the permit area, <br />delineating the affected acreages. The operator was also requested to clean <br />up some of the none mine waste scattered through out the permit area. In <br />addition operator was informed not to allow a lot of water in the pits that <br />is more than his allowable water rights for evaporative loss. The original <br />compliance date was January 27, 2005. Operator requested a 30-day <br />extension, which the Division granted, because the operator plans to <br />succeed the permit from Castle Rock, Rock. At present he is operating the <br />mine by sub letting it from the current permit holder, Castle Rock, Rock. <br />Since the existing warranty appears to be adequate the current disturbance, <br />the Division granted the extension TO 2/28/05. On 2/28/05 Mr. Miner <br />contacted the Division requesting another 30-day extension and requested a <br />site visit to see the progress made in cleaning up the site. <br />The operator had made significant progress to remove some of the none mine <br />waste. The water from the wash pond was being diverted into the pit. <br />Operator claims due to a lot of snow melt from the higher areas outside of <br />the permit draining into their pond, they decided as a temporary measure to <br />route it into the Western pits that have already been mined. Since the <br />operator has a water substitute supply plan from the State Engineers <br />Office, the temporary storage of the water in the pits does not appear to <br />be a problem. The operator plans to reclaim that portion of the pit as soon <br />as the permit is transferred. The operator was also informed if the wish <br />was to limit the recalamtion liability; it will be to their advantage to <br />place the topsoil/ overburden in areas closer to the pits, to shorten the <br />haul distance. At present top soil/ overburden was scattered through out <br />the active mining areas. He agreed to bring a scrapper next week to place <br />the top soil/ overburden in two or three areas near the pits. He was also <br />requested to place the location of these piles in the new map to be <br />submitted. In addition, he as informed that this would be the last 30-day <br />extension that will be granted. If the material submitted is not provided <br />by 3/28/05, the financial warranty will be calculated based on what was <br />observed on site. He agreed to provide the requested information on or <br />before the due date. <br />
