III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the CDMG. This site is <br />currently in active status, but for all practical purposes it is in a temporary <br />shutdown status until coal mining at the Lorencito Canyon mine resumes. <br />Contractors were on-site evaluating changes to the power distribution at the site <br />for future operations. Ground conditions were dry and the weather was cool and <br />breezy. <br />Availability of Records <br />The public copy of the mine records is kept at the small office at the Tri-State <br />railyard south of Highway 12 on the west side of Trinidad. All required records <br />were found in compliance and up-to-date. The operator has requested a copy of the <br />road certification document from Technical Revision ~~48 to complete the copy of <br />the mine records. <br />Hydrologic Balance <br />Dry conditions have prevailed at the site fora number of weeks. Pond 7 is <br />essentially dry. The operator should evaluate the need for erosion protection <br />below the pond 7 gated outlet. Pond 8 holds a significant amount of water and <br />captures runoff from the Refuse Disposal Area (RDA). Water level was observed <br />some five feet below the primary outlet. Pond 4 held a small puddle of water in <br />the southeast corner. Pond 5 and the five small containments were dry. Ditches <br />and culverts appeared in good condition throughout the site. If the preparation <br />plant becomes active in the future, the straw bales at the river/RDA conveyor <br />intersection will need to be replaced. <br />Processing Waste <br />The maintenance work on the east downdrain at the RDA has been completed. It <br />appears that flows will now be contained within the downdrain channel due to this <br />maintenance work. The 100-year diversion above the RDA was traversed and found in <br />functional condition. No slumps, slides, springs, seeps, or damage of any kind <br />was noted on the reclaimed outslopes of the RDA. The operator may want to re-cut <br />the ditches on the working surface of the RDA that help divide the runoff somewhat <br />equally to the east and west downdrains. <br />3 <br />
