JII. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection: Comments ttlso describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Jim Kiger <br />represented the operator during the records check part of the inspection. There were no coal railcar <br />loading or coal haul truck unloading operations during the inspection. <br />Facilities <br />About 20 loaded railcars were on site. There were no empties on site but some are being brought in for <br />loading tomorrow. The coal stockpile was fairly large but no fugitive dust problems were observed. <br />There were no problems observed at the office and shop azea, the material storage area and the <br />substation. The containment berm at the fuel facility was functional. No fuel leaks were seen. <br />HvdroloQy <br />There was a little water in the east pond. The gated primary valve was closed. The pond inslopes were <br />stable. The pond embankment was well vegetated and stable. The primary and emergency spillways <br />were functional. The west dugout pond was dry. The spillway was functional. <br />All of the culverts and ditches around the loadout site were recently maintained. The straw bales and <br />silt fence at the railroad small area exemption were intact. <br />Roads <br />The main paved haul road was in excellent condition. The guard rail was in place. The east side road <br />was graveled and dry. The light use road along the tracks was passable. <br />Signs and Markers <br />Mine ID signs were up at the maip entrance, the east entrance and near the railroad tracks. The <br />information on the signs was correct. Permit boundary mazkers were present azound the mine site. <br />Topsoil 5tockniles <br />The vegetative cover on the north side ofthe west topsoil stockpile was good., However, that on the <br />south side was sparse. On the east topsoil stockpile, the vegetative cover was moderate. Collection and <br />diversion ditches at the two topsoil stockpiles were functional. Topsoil stockpile signs were up. <br />Records <br />The records were in compliance, as documented in the following records checklist. <br />c:/word/terror/insp0404 <br /> <br />
