<br />(Page 2) • <br />MINE ID # OR PROSPECTING ID # M-1987-113 <br />INSPECTION DATE 4/05/00 INSPECTOR'S INITIALS CLK <br />OBSERVATIONS <br />This routine inspection was done to verify that no disturbance had occurred at this site, which has never had a financial warranty <br />posted for the permit area. This 112 application was approved in 1987, but was never mined due [o litigation issues between the <br />landowner and the Department of Defense. The lawsuit was recently resolved so that Church Ranch can legally mine this area, if <br />they so choose. <br />However, no permit has ever been issued for this site because the financial warranty was never posted, so the applicant may not <br />mine this area at this time, in accordance with Rule 4.2. I (I) of the Conswcrion Materials Rules and Regulations. While it has been <br />left as undisturbed pasture land, it has been 13 years since the application was approved. If the applicant wishes to mine this site, <br />a new application must be submitted and approved by the Division, and sufficient financial warranty posted to cover the cost of <br />reclaiming [he maximum area to be disturbed. <br />DMG requests that the Operator send a formal letter withdrawing this application from the permit process, and re-submit a new <br />application, if they still intend to mine the site. If such a letter is not received by April 24, 2000, this application will be <br />scheduled for denial before the Mined Land Reclamation Board hearing during the month of May, based on the failure to post <br />adequate bond within 365 days of permit application approval.
