I(I. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />June 9, 2003 and June 12, 2003 by Mike Boulay of the DMG. There was no representative from <br />Kerr Coal Company present during the inspection. Weather conditions were clear and cool. <br />Ground conditions at the mine site were saturated and muddy due to heavy precipitation from the <br />previous night. There was no activity at the mine site during the inspection. Access to the site <br />was limited due to very muddy conditions. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson ~azza office in Steamboat Springs on the <br />afternoon of June 9, 2003. Improvements have been made to the record keeping and filing <br />system. The records have been updated since the time of the last complete inspection. With only <br />minor exceptions, all required records were on file and available for review. Please see the <br />attached Availability of Records checklist. <br />Roads <br />The permanent light use road that accesses the site was saturated and extremely muddy due to <br />heavy rain from the night before. The road became slick and heavily rutted by driving on it. <br />Access to the site was limited to the approximate location of Pond D. <br />>~drologic Balance <br />Site sedimentation ponds D, E, F, and G were inspected. Pond D, E, and F were full and <br />discharging small quantities of water. The access road into Pond G was also very slick. Pond G <br />was retaining water but was not dischazging. Pond inlets, dischazge structures and embankments <br />were functioning as intended and no problems were noted at any of these pond locations. <br />Loadout <br />The loadout facility was inspected. The ground surface was muddy and some azeas of the site <br />had standing water. The loadout pond was full and discharging to the perimeter canal. <br />Perimeter azeas of the site were maintained and no problems were noted. <br />
